These Terms and Conditions apply to the use of the Stone Cut website, enquiries, quotations, orders and the supply, fabrication, delivery and installation of products and services by Stone Cut Ltd.

Please read these Terms and Conditions carefully before placing an order with us. By accepting a quotation, paying a deposit, placing an order or instructing us to begin work, you agree to these Terms and Conditions.

In these Terms and Conditions, “Stone Cut”, “we”, “us” and “our” refer to Stone Cut Ltd. “Customer”, “you” and “your” refer to the person or business purchasing our products or services.

2. Our Products and Services

Stone Cut supplies, fabricates and installs made-to-measure stone products including, but not limited to:

  • Quartz worktops
  • Granite worktops
  • Marble worktops
  • Porcelain worktops
  • Dekton worktops
  • Kitchen worktops and islands
  • Bathroom countertops and vanity tops
  • Splashbacks and upstands
  • Bespoke stone pieces
  • Templating, fabrication, delivery and installation services

Most products supplied by Stone Cut are manufactured specifically for an individual project and are therefore bespoke or made to measure.

3. Quotations

Any quotation issued by Stone Cut is based on the information, drawings, dimensions and specifications available to us at the time.

Unless otherwise stated, quotations may be subject to adjustment if:

  • Measurements or specifications change;
  • Additional material is required;
  • Additional cut-outs, edge details, upstands, splashbacks or other features are requested;
  • Site conditions differ from those originally described;
  • Additional labour or visits are required;
  • The customer changes the material, thickness, design or layout;
  • Access or installation requirements change.

A quotation does not become a confirmed order until Stone Cut accepts the order and any required deposit or payment has been received.

We reserve the right to withdraw or amend a quotation before an order is confirmed.

4. Measurements and Templating

Where Stone Cut carries out templating, final fabrication will normally be based on our template rather than preliminary measurements.

Before templating takes place, base units and supporting structures must be fully installed, correctly positioned, level, secure and ready for measurement unless otherwise agreed.

Sinks, hobs, taps and any other items requiring cut-outs should be available at the property or their exact manufacturer specifications must be supplied before fabrication.

Stone Cut will not be responsible for delays or additional costs caused by incomplete kitchens, missing appliances, incorrect information or changes made after templating.

Where customers, kitchen companies, builders or other third parties provide measurements instead of Stone Cut carrying out a template, responsibility for the accuracy of those measurements remains with the party supplying them.

5. Approval of Specifications

The customer is responsible for checking and approving the agreed:

  • Material and colour;
  • Stone thickness;
  • Worktop dimensions;
  • Edge profile;
  • Sink and hob cut-outs;
  • Tap holes;
  • Drainer grooves;
  • Upstands and splashbacks;
  • Overhangs;
  • Joints;
  • Other fabrication details.

Once fabrication has started, changes may not be possible. Where changes can be accommodated, additional charges may apply.

6. Natural and Engineered Stone Characteristics

Stone is a natural or manufactured material whose appearance can vary.

Natural materials such as granite and marble may contain variations in:

  • Colour;
  • Pattern;
  • Veining;
  • Mineral deposits;
  • Texture;
  • Pitting;
  • Fissures;
  • Natural markings.

Engineered quartz and other manufactured surfaces can also vary between batches, slabs, samples and website photographs.

Samples, photographs and showroom displays should therefore be regarded as representative rather than an exact guarantee of the final slab.

Reasonable variations that are normal characteristics of the chosen material will not normally be considered defects.

Where possible, customers may be offered an opportunity to view or approve slabs before fabrication.

7. Joints and Vein Matching

Where a worktop requires more than one piece, visible joints may be necessary.

Stone Cut will take reasonable care when positioning joints and matching patterns or veins, but exact continuation of veining, colour or pattern across separate pieces cannot always be guaranteed.

The number and position of joints may also be influenced by slab dimensions, access, structural requirements, installation safety and fabrication limitations.

8. Prices and Payment

Prices will be stated on the quotation, invoice or order confirmation.

Any applicable taxes and additional charges will be shown or communicated as required.

The payment schedule will be stated on the quotation or invoice. A deposit may be required before materials are ordered, templating is undertaken or fabrication begins.

The remaining balance must be paid in accordance with the agreed payment terms.

Stone Cut may postpone fabrication, delivery or installation where payment is overdue.

Any additional work requested after confirmation of the original quotation may be charged separately.

9. Deposits and Commencement of Fabrication

Once a customer approves the order and Stone Cut purchases or allocates materials, completes templating or begins fabrication, costs will have been incurred specifically for that project.

Because most Stone Cut products are bespoke and made to individual measurements, an order may not be cancellable once fabrication has begun.

Any refund of a deposit before fabrication begins will depend on whether Stone Cut has already incurred costs in connection with the order and on the customer’s statutory rights.

10. Cancellation and Change of Mind

Many Stone Cut products are custom-made to a customer’s individual measurements and specifications.

For this reason, the normal right to cancel an online or distance purchase because of a change of mind may not apply to bespoke or personalised products.

Once templating or fabrication has begun, Stone Cut will normally be unable to cancel an order or provide a refund because the customer:

  • Changes their mind;
  • Selects a different colour or material;
  • Changes the kitchen design;
  • Changes appliance positions;
  • Provides revised measurements;
  • No longer requires the worktop.

This section does not affect any statutory rights relating to faulty goods or services.

11. Delivery

Any delivery or installation date provided by Stone Cut is an estimate unless we expressly agree otherwise in writing.

We will make reasonable efforts to meet agreed timescales, but delays may occur because of circumstances including:

  • Material availability;
  • Supplier delays;
  • Fabrication requirements;
  • Vehicle or equipment problems;
  • Severe weather;
  • Site access issues;
  • Changes requested by the customer;
  • Events outside our reasonable control.

Customers must provide safe and reasonable access to the property for delivery.

Stone worktops can be extremely heavy. The route from the delivery vehicle to the installation area must therefore be clear and suitable for safely carrying the stone.

12. Installation

Where Stone Cut has agreed to provide installation, the installation area must be ready before our team arrives.

This includes ensuring that:

  • Cabinets are correctly fitted and secure;
  • Units are level and sufficiently supported;
  • Access routes are clear;
  • Appliances or fittings that need to be present are available;
  • Electricity, gas or plumbing arrangements do not prevent installation.

Stone Cut may postpone an installation where the site is unsafe or not ready.

Additional visits or work required because the property was not ready may incur additional charges.

Unless specifically included in the quotation, Stone Cut is not responsible for plumbing, electrical, gas, carpentry, decorating or other unrelated building work.

13. Existing Walls, Cabinets and Property

Walls, cabinetry and buildings are not always perfectly straight, square or level.

Small gaps between stone surfaces and existing walls may therefore occur and may require finishing by a kitchen installer, decorator or other tradesperson.

Stone Cut will take reasonable care during installation but will not be responsible for pre-existing defects, poorly installed cabinetry, structural movement or defects in work carried out by other contractors.

14. Inspection Following Installation

Customers should inspect the worktop following installation and inform Stone Cut as soon as possible if they believe there is damage, an incorrect item or another issue.

Under Stone Cut’s commercial Returns and Refunds Policy, refund requests should be submitted within 7 days following installation, together with details and photographs of the problem where appropriate.

This seven-day reporting period does not remove or limit any statutory rights relating to faulty goods or services.

15. Damage During Fabrication, Delivery or Installation

Stone Cut accepts responsibility for damage caused by us to the worktop during fabrication, handling, delivery or installation.

If a stone piece is broken or seriously damaged while under Stone Cut’s responsibility, we will assess the circumstances and provide an appropriate remedy.

Depending on the situation, this may include:

  • Repair;
  • Re-fabrication;
  • Replacement;
  • Partial refund;
  • Full refund.

Stone Cut will determine the appropriate remedy after assessing the nature and extent of the problem and subject to the customer’s statutory rights.

16. Damage After Installation

Once installation has been completed, Stone Cut will not normally be responsible for damage caused subsequently by circumstances outside our control.

Examples include:

  • Accidental impact;
  • Dropping heavy objects;
  • Standing or sitting on worktops;
  • Excessive weight;
  • Thermal shock or inappropriate exposure to heat;
  • Movement of cabinetry, walls or flooring;
  • Structural movement;
  • Incorrect cleaning chemicals;
  • Improper maintenance;
  • Alterations performed by another contractor;
  • Plumbing leaks;
  • Subsequent building work;
  • Removal or refitting by third parties.

A full refund will not normally be available where the problem was not caused by a defect or by work for which Stone Cut was responsible.

Nothing in this section limits any statutory consumer rights.

17. Care and Maintenance

Customers are responsible for following appropriate care instructions for the material purchased.

Different materials have different levels of resistance to staining, scratching, heat and chemicals.

Customers should:

  • Use chopping boards rather than cutting directly on the surface;
  • Use suitable trivets or heat protection where recommended;
  • Avoid harsh or unsuitable chemicals;
  • Clean spills promptly where required;
  • Follow any manufacturer-specific care instructions.

Damage resulting from misuse or failure to follow appropriate care guidance may not be covered by Stone Cut or a manufacturer’s warranty.

18. Manufacturer Warranties

Certain products may be covered by a manufacturer’s warranty.

Warranty conditions vary depending on the manufacturer and product and may require registration by the customer.

Manufacturer warranties are separate from the customer’s statutory rights and may contain their own exclusions and claim procedures.

Where Stone Cut provides its own specific warranty, the applicable warranty terms should be read together with these Terms and Conditions.

19. Complaints and Problems

Please provide your name, project details, installation date, explanation of the issue and photographs or videos where relevant.

We may ask to inspect the worktop before deciding on an appropriate remedy.

Customers should not arrange for another contractor to alter, remove or repair the affected worktop before giving Stone Cut a reasonable opportunity to inspect it, where reasonably possible.

20. Website Information

We make reasonable efforts to ensure that information on stonecut.co.uk is accurate.

However:

  • Product photographs may appear differently depending on lighting and screen settings;
  • Stone colours and patterns may vary;
  • Products and materials may be discontinued or become unavailable;
  • Prices, promotions and specifications may change.

Website information does not override the specifications contained in an accepted quotation or order confirmation.

21. Website Intellectual Property

Unless otherwise stated, the content of the Stone Cut website, including text, branding, graphics, layouts and original photographs, belongs to Stone Cut Ltd or is used with permission.

Content may not be reproduced, republished, distributed or used commercially without prior permission, except where permitted by law.

Our website may contain links to third-party websites.

Stone Cut is not responsible for the content, security, privacy practices or availability of third-party websites.

23. Personal Information

We process personal information in accordance with our Privacy Policy and applicable UK data protection legislation.

Customers should review our Privacy Policy for information about how we collect, use and protect personal information.

24. Events Outside Our Control

Stone Cut will not be responsible for delay or failure to perform an obligation where this results from circumstances outside our reasonable control.

Examples may include severe weather, fire, flooding, transport disruption, supplier failure, shortages, industrial action, government restrictions, utility failures or other exceptional events.

Where such an event occurs, we will make reasonable efforts to minimise disruption and complete the order as soon as reasonably possible.

25. Limitation of Liability

Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so.

Subject to applicable law, Stone Cut will not be responsible for losses that were not reasonably foreseeable when the contract was formed or for losses resulting from circumstances outside our reasonable control.

For business customers, Stone Cut will not normally be responsible for indirect or consequential business losses such as loss of profit, loss of revenue, loss of contracts or loss of business opportunity.

Nothing in these Terms and Conditions affects the legal rights of consumers.

26. Your Statutory Rights

Nothing in these Terms and Conditions is intended to exclude or restrict rights provided to consumers under applicable UK law.

Where goods are faulty, not as described or not of satisfactory quality, or where services have not been performed with the legally required degree of care and skill, customers may be entitled to remedies provided by law.

27. Changes to These Terms

Stone Cut may update these Terms and Conditions from time to time.

The Terms and Conditions applicable to an order will generally be those in effect when that order is confirmed, unless a change is required by law or otherwise agreed with the customer.

The latest version will be published on stonecut.co.uk.

28. Governing Law

These Terms and Conditions and any contract between Stone Cut and a customer are governed by the laws of England and Wales.

If you are a consumer, you may also have rights to bring proceedings in the courts applicable to the part of the United Kingdom in which you live.
