Terms and Conditions - 10 Years Warranty for Kitchen Worktops (Quartz Stone Material)
These Terms and Conditions govern the warranty provided by Stone Cut Ltd for kitchen worktops made from quartz stone material. By purchasing and installing the Product, the Customer agrees to be bound by the terms outlined below:
1. Warranty Coverage:
a. The Company warrants the Product to be free from defects in materials and workmanship for a period of 10 years from the date of installation.
b. This warranty is applicable only to the original Customer and is non-transferable.
2. Warranty Exclusions:
This warranty shall not cover:
a. Damage caused by improper installation, misuse, abuse, accident, negligence, or acts of nature.
b. Damage resulting from exposure to extreme temperatures or chemicals not recommended for use on the product.
c. Damage caused by alterations, modifications, or repairs carried out by unauthorized personnel.
d. Normal wear and tear, discoloration, or variations in the natural pattern of the quartz stone material.
e. Cracks or damages occurring due to the Customer's failure to maintain or clean the Product as per the provided guidelines.
3. Warranty Claims Procedure:
a. In the event of a warranty claim, the Customer must notify the Company within 30 days of discovering the alleged defect.
b. The Company reserves the right to inspect the Product before processing any claim.
c. To initiate a claim, the Customer should contact the Company through the provided customer service channels, providing proof of purchase and detailed information about the alleged defect.
d. The Company may request additional documentation, photographs, or on-site inspections to assess the claim.
e. If the claim is deemed valid, the Company will repair or replace the defective Product or remedy the issue in another suitable manner.
4. Limitations of Liability:
a. The Company's liability under this warranty is limited to the repair or replacement of the defective Product, or the refund of the purchase price paid by the Customer.
b. The Company shall not be responsible for any indirect, consequential, incidental, or punitive damages arising from the use or inability to use the Product.
5. General Provisions:
a. This warranty only applies to Product installations within the specified geographical area as indicated by the Company.
b. This warranty is subject to any local or national laws applicable to warranties.
c. Any disputes arising from or related to this warranty shall be governed by the laws of the jurisdiction where the Product was installed.
d. The invalidity or unenforceability of any provision within this Agreement shall not affect the validity or enforceability of the remaining provisions.
e. The Company reserves the right to modify or update these terms and conditions at its discretion, with notice provided to the Customer.
6. Transferability and Extensions:
a. This warranty is non-transferable and applies only to the original Customer. It cannot be transferred to any subsequent owners of the Product.
b. Extensions to the warranty period may be available for an additional fee, subject to the Company's terms and conditions. Customers interested in extending their warranty should contact the Company for more information.
7. Maintenance and Care Requirements:
a. The Customer is responsible for properly maintaining and caring for the Product according to the guidelines provided by the Company.
b. Failure to comply with the specified maintenance and care requirements may result in the warranty being voided.
c. The Company recommends regular cleaning with mild soap and water or a suitable non-abrasive quartz cleaner. The use of harsh chemicals or abrasive cleaners should be avoided.
8. Exclusion of Third-Party Costs:
a. The Company shall not be liable for any costs or expenses incurred by the Customer for the removal, transportation, installation, or reinstallation of the Product or any associated components.
b. Any costs associated with repairs, modifications, or alterations carried out by unauthorized personnel shall be the sole responsibility of the Customer.
9. Dispute Resolution:
a. In the event of a dispute arising from or related to this warranty, the Customer agrees to first attempt to resolve the matter through negotiation with the Company.
b. If a resolution cannot be reached through negotiation, the Customer agrees to pursue mediation or arbitration as a means of alternative dispute resolution.
c. Any costs incurred for mediation or arbitration shall be shared equally between the Customer and the Company.
10. Severability:
a. If any provision within this warranty is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired in any way.
b. The parties shall endeavor to replace the invalid provision with a valid one that achieves the intended economic and legal effect.
11. Entire Agreement:
a. These Terms and Conditions constitute the entire agreement between the Customer and the Company regarding the warranty for the Product.
b. No other agreements, warranties, or representations, whether oral or written, shall be binding unless expressly stated in these Terms and Conditions.
12. Modification of Terms:
a. The Company reserves the right to modify or update these Terms and Conditions at any time, with notice provided to the Customer.
b. Such modifications or updates shall apply to any future purchases or warranty claims made by the Customer after the effective date of the modified terms.
By purchasing and installing the Product, the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions governing the 10-year warranty provided by Stone Cut Ltd for kitchen worktops made from quartz stone material.
